Enclosed Gardens General Conditions of Entry

Assumption of Risk
Visitors enter the Enclosed Gardens at their own risk and choose to do so under these Terms and Conditions. No liability for loss, injury or damage will be accepted.
- Ticket and Pass Requirements
Visitors must hold a valid ticket or MyGardens Pass and present this on entry to gain access to the Enclosed Gardens.

Child Supervision
All children under the age of 14 years must be accompanied by an adult.

Right to Close or Restrict Access
Hamilton Gardens has the authority to close the Enclosed Gardens or any part thereof, including any individual Garden, for any reason whatsoever including for private events, maintenance, or in the interests of safety and will not be liable for any loss or expense incurred by a visitor as a result of such closure or variation.

Prohibited Items
For your own safety, and the safety of other visitors, you are not permitted to bring the following into the Enclosed Gardens: scooters, skateboards, rollerblades/skates, bicycles/tricycles or similar, motorised vehicles (excluding mobility scooters), animals (excluding assistance dogs), remote controlled vehicles and devices (including drones unless prior permission has been granted), cooking equipment, alcohol, weapons, fireworks or illegal substances.

Alcohol and drug use
Any person who appears to be under the influence of alcohol or drugs will be refused admission or escorted from the Enclosed Gardens.

Smoking and Vaping
Hamilton Gardens is smoke-free environment, as such, smoking and vaping are not permitted within the Gardens.

Protection of Gardens
Visitors must not pick flowers or leaves, take fruit or plants, or otherwise damage or alter the gardens in any way.

Path and Area Restrictions
Visitors must stay on paths and within public areas, they must not enter garden beds, Staff service lanes, or water features or climb on Garden structures, sculptures or railings.

Compliance with Instructions and Emergency Procedures
All visitors are required to follow all conditions and instructions displayed within the Enclosed Gardens or communicated by Staff. In the event of emergency, visitors must follow the instructions of Staff and use designated evacuation routes.

Appropriate Attire
All visitors must wear attire appropriate for a community facility. Hamilton Gardens reserves the right to refuse entry to visitors wearing costumes or items of clothing that may, at Hamilton Garden's absolute discretion, be considered objectionable or have a negative impact on other visitors.

Behavioral Expectations
All visitors must behave in a way that is appropriate for a family environment. Hamilton Gardens reserves the right to refuse entry and/or remove any visitors from the Enclosed Gardens who use threatening, abusive or insulting words or behaviour or in any way provoke or behave in a manner which may provoke a breach of the peace, affect the enjoyment of other visitors or endanger the safety of themselves or others.

Lost Property
Hamilton Gardens is not responsible for any lost or stolen items. Any found items should be handed to Staff. Please contact the Visitor Centre team if you require details of our lost property policy.

Photography and Video Recording
From time-to-time Hamilton Gardens or other authorised parties carry out photography and/or video recording on Hamilton Gardens grounds, which may feature visitors. By accepting these Regulations, you agree that Hamilton City Council or any authorised party may use such images in perpetuity in any promotional, advertising or publicity material in any format whatsoever. You further agree that copyright in these materials rests with Hamilton Gardens or such authorised party (as the case may be). Hamilton City Council privacy policy can be found on our website here.

Commercial, Busking, Demonstrations and Charitable Activities
Visitors must obtain written permission from Hamilton Gardens before conducting any commercial, busking or charity activity on Hamilton Gardens grounds.
Professional/commercial photography and filming in the Enclosed Gardens is permitted only by prior arrangement with Hamilton Gardens.
If you intend to host a protest or demonstration, please discuss your plans with our staff prior to the event. This will help ensure that all planning and safety measures are appropriately in place.

Trespass
Unauthorised access to the Enclosed Gardens or marked no-entry areas is strictly prohibited. Anyone attempting to enter without permission will be reported to the authorities.

Enforcement of Terms and Conditions
Hamilton Gardens retains the right to deny access and/or remove any visitors who fail to comply with these terms and conditions.
Online entry ticket terms and conditions:
- Enclosed Gardens entry tickets purchased online are valid for the selected date only. You can manage your booking and reschedule online if required.

Final admission is 30 minutes prior to closing, please check the website for the closing time on the date you are visiting.

Online admission tickets are non-exchangeable, non-refundable and void if altered.

If a Cardholder ticket (SuperGold, Community Services, Student) is purchased, a valid form of ID is required to be presented upon entry

All persons (including children under 16 years old) entering the Enclosed Gardens must hold a valid ticket or pass which must be submitted for inspection upon request by any member of staff.

If a child ticket is selected for a teenage child, you may be asked to provide proof of age/DOB on entry.

Enclosed Gardens entry tickets may not be used for advertising, promotion, competitions or other commercial purposes without the express written consent of Hamilton Gardens.

One caregiver is given free entry when accompanying disabled persons aged 16 years or older (children under 16 years are free) who require assistance. We do ask for suitable supporting documentation and identification e.g. Community Services Card or a letter from a health practitioner. Please let our Visitor Centre team know on arrival.

By purchasing an entry ticket, you agree to the terms and conditions of entry

Each ticket is valid for a single entry only, if you wish to leave and re-enter the Enclosed Gardens on the same day, please retain your ticket and speak to our Visitor Centre team as you exit to request a re-entry pass.
Audio Guide terms and conditions:

Hamilton Gardens Audio Guides are for use within the Enclosed Gardens, for the purpose of playing the loaded audio content only.

The audio guides contain 75minutes of pre-recorded content split across 50 stops, the hire duration is for up to two hours per hire.

Units must be returned to the Information Desk at the Gallagher Visitor Centre upon exiting the Enclosed Gardens.
Highlights Tour terms and conditions:

Scheduled public tours are subject to availability, booking is strongly advised.

Bookings are essential for private tours and are for up to 5 people. Additional participants can be added for $35pp adult / $15pp child.

Participants should plan to arrive at the Gallagher Visitor Centre at least 10 minutes before the tour is scheduled to start. In the case of late arrivals there is no guarantee that the finish time will be able to be extended to accommodate a full 75-minute tour.

A full refund will be given for cancellations made more than 72 hours prior to the tour start time. No refund will be given for guided tour cancellations made within less than 72 hours of tour start time, or for no-shows and late arrivals.

A moderate amount of walking is involved (approximately 1.5 kilometres over a 75-minute period). Suitable walking shoes (no high heels) should be worn. The tour experience is fully accessible, wheelchairs and mobility scooters are available for hire with prior arrangement.

Highlights Tours will operate in all other weather conditions. In the instance of extreme weather events, we reserve the right to amend or cancel.
MyGardens Pass terms and conditions:

MyGardens Passes are non-transferrable, non-refundable and non-exchangeable.

A MyGardens Pass entitles the named member(s) only to unlimited entries to the Enclosed Gardens at Hamilton Gardens for the life of the pass.

Ratepayers to Hamilton City Council, or those that have permanent residence within the local authority of Hamilton City Council are entitled to a free MyGardens Resident Pass.

Hamilton residents must provide proof of address and photo ID to validate their MyGardens Pass before it can be used to receive free entry to the Enclosed Gardens.

The MyGardens Annual Pass is valid for 12 months from the date of purchase. MyGardens Resident Pass is valid for 24 months from the date of activation. MyGardens Lifetime Passes are only issued at the Director’s discretion, they are not available for purchase and are valid in perpetuity for the named recipient only.

ID photo(s) will be taken and attached to your membership.

Your personal information including photo will be stored securely in our ticketing platform, powered by Roller. Roller and Hamilton City Council operate in accordance with the Privacy Act, GDPR and CCPA, you can read our privacy policy here: hamilton.govt.nz/privacy-policy/

Additional people can be added to the same MyGardens Pass (annual pass or Hamilton resident variants). Each additional member aged 16 or over will be required to provide proof of address and photo ID or pay the purchase price for an annual pass. Children under 16 years of age can be added to the pass without photo ID or proof of address.

Your digital or physical pass must be presented for scanning at the entry point to the Enclosed Gardens on each visit.

By using your MyGardens Pass to enter the Enclosed Gardens you agree to the terms and conditions of entry.

The MyGardens Pass is valid for standard entry to the Enclosed Gardens during public open hours only, it is not valid for special events that require a separate booking or ticket.

A $5 fee will be charged for all replacement cards issued.
